 Re:    Formal Complaint Against Officer Sh. Rajpal AETO (Enf), presently posted at Jagadhari.

 Most respectfully submitted as under:

 1.     We are writing to bring to your attention a recent incident in which we believe our rights as a citizen were violated by Officer Sh. Raj Pal. We are deeply concerned about the officer's conduct during the incident and subsequent refusal to provide necessary documents, as well as the threatening behaviour towards taxpayers.

 2.     On 07/06/2023, Officer Sh. Raj Pal, who recorded the statement in Mov-01 and handed over the copy without any description, his name, designation, and contact number, intercepted a vehicle coming from Delhi to Himachal Pradesh. An order in Mov-02 was issued for physical inspection of the goods, also without his own name and designation.

 3. When the owner taxpayer from Delhi called Officer Sh. Raj Pal to inquire about the reasons for asking to pay the penalty, he replied that the penalty must be paid before the goods would be released. The taxpayer deposited the penalty amount through DRC-03 under protest and got the goods released. However, the penalty was deposited under protest without the issue of Mov-07 and Mov-09.

Failure To Provide Documents:

4.     Despite our lawful request and in accordance with our rights as a taxpayer, we have not received any of the requested documents, including Mov-04, Mov-06, Mov-07, and the final order in Mov-09. This lack of transparency is deeply troubling and raises concerns about the officer's integrity & adherence to departmental policies and the law.

THREATENING BEHAVIOR:

5. Furthermore, Officer Sh. Raj Pal made alarming and threatening comments towards Taxpayer of Delhi, stating that "if you go for appeal, then I will impose a penalty time and again on your supply to Himachal Pradesh." Such actions undermine the public's trust in law enforcement and raise serious questions about the Officer's integrity and ability to carry out their duties impartially.

 6.  I kindly request a thorough investigation into this matter to address our concerns and uphold the principles of accountability and transparency. We believe that a prompt and impartial investigation is necessary to determine the culpability of Officer Sh. Raj Pal. We urge you to take appropriate action based on the findings of the investigation, which may include disciplinary measures if misconduct is confirmed.

 7.     I expect a response to this complaint within a reasonable time frame to ensure that this matter is addressed promptly and appropriately. Please acknowledge receipt of this complaint and provide us with a contact person's name and information to facilitate communication throughout the investigation.

 8.     We trust that you will take this matter seriously and are committed to maintaining the highest standards of integrity and accountability among your officers. We appreciate your attention to this important issue and look forward to a timely resolution

Note: Although this is a specific complaint, it is concerning that incidents like this are frequent. It appears that the officers are pressuring the taxpayer to deposit the tax without issuing the necessary notices and orders. It is mandatory to upload these documents on the portal for submission of a reply by the taxpayer. This is a serious matter and should be treated as a representation.
